There is a small admin fee of £15.00 which is payable once with every loan.

General Charge
  • Listed finance charges include any applicable taxes and bank delivery charges.
  • We keep the right to change the finance charges without any notice. This will not affect your current Loan agreement with us. Any changes made to our General Charges would be updated on our website.
  • The finance charge that applies to you will be set out in your loan agreement and will apply for the term of your loan agreement.
  • The loan payment can be made by Faster Payment or BACS. Faster Payment service incurs a charge of £15 to £25 which is deducted from your loan amount and you will receive your money in the same day. BACS option is free and you will receive your money in 3 - 4 working days.
Loan Extension
  • If you cannot pay your loan in full by the agreed date you will have an opportunity to extend your account.
  • You may do so by paying all the charges and interest accrued as a result of your loan.
  • By doing so, you may extend your loan agreement for the same length as your previous loan or choose to extend it to 30 days. New charges would apply.
  • A new loan agreement will have to be signed based on interest rate which is 39%.
  • The charges will therefore be £19.50 for every £50 you borrowed.
Default Charges

If you default and Wage Payday and Payday Loans Ltd offer you a repayment plan, interest at a minimum will include 90 days interest in default and then have the option of being frozen after this 90 days. This is on the basis that the agreement is made before 90 days in default. Also any break in the repayment will re add all the past interest that would have been charged if in continued default.

If you default there is a non collection fee of £25.00 for NON PAYMENT plus a letter charge of £25.00.

This applies even if you miss the last payment as we have to do the same work as if you had just started.

The biggest problem we have is that our loans are small. If we had big loans like the big 5 banks they charge the same default charges BUT we are lending small amounts so the amounts look unreasonable. However we pay our staff the same salaries as the other companies so cannot afford to charge less. OUR ADVICE-DON,T BREAK THE REPAYMENT PLAN.

ie Winnie borrows 100. After one month @ 29% plus admin fee of £15 she owes £144.00. She fails to pay and then has a default rate of 1.3% per day. On default there is an £25 no collect fee. Plus a £25.00 letter chasing fee. She now owes £194 plus interest of £1.87 per day(1.3% on £144). We agree a repayment plan on default day 45, interest is calculated 60 x £1.75=£112.2 and the interest and charges are frozen. then the late fees of £25.00 x 2(prior to 60 days agreement)plus the default fee and a set up fee of £25.00 each then lead to a total to commence the plan of £290.53

There has been another £25.00 default letter issued after 30 days so now the outstanding is £140+£100.53+£50+£25+£25=£340.53. The plan she agrees to is £40 per month.

In addition there is a charge of £4 x 9=£36 for the monthly monitoring fee. The final total in this example is £376.53 so is therefore 9 months at £40 and 1 month at £11.53.

However, Winnie after 3 months breaks the contract and stops paying. She now has all the interest brought up to date as if the deal had not been there and now owes £352.53(4x 3 months monitoring) an default fee of £25.00 plus a new letter of £25.00 less 2 month,s payment £80 plus interest at 1.3% per day on any outstanding amount as of that particular day.

We have these charges as when you default it creates a great deal of work and time for us to chase and recollect.

Please if you aim to default or don't believe you can pay us and will get into financial difficulties PLEASE DO NOT BORROW FROM US as we wil charge you and chase your debt all the way to the court and beyond.

BEYOND

Beyond is the following options open to us.

1/ Court application and judgement-if you then agree to an offered and accepted repayment plan we will not need to go further subject to NON breakage of the plan and all the repayment plans terms and conditions complied with.

2/ Attachment of earnings-we will bypass you and go to your employers with a court order. If you suffer loss of income or job we cannot be help responsible.£275 costs borne by you.

3/ Bailliffs-who visit your home.£195 costs borne by you

4/ garnishee order-we will freeze your bank accounts and will have the right to do this under the terms and conditions. Any costs incurred will be borne by yourself. £350.00 costs borne by you.

5/ Bankruptcy order £750 costs borne by you.

Repayment terms

If we agree to a repayment term it is on the minimum basis of 60 days late.

We charge a fee between £4.00 to £6.00 per month to monitor the loan to include chase up emails and telephone calls around your due date. We reserve the right to charge more if you are particularly difficult and do not pay and need constantly chasing.

We have a charge of £25.00 to set one up and a failure fee of £25.00 if the repayment term fails due to non payment. In addition we charge a fee of £25 for a letter to be written to you asking about the failure of the repayment plan.

There is an admin fee of £4.00 per month per repayment agreement for monitoring, emails and time to keep up the repayment plan with us.

Any failure of a repayment term will IMMEDIATELY go to court BUT we can enter into another repayment term if we decide to do so but will incur another charge of £25.00 to set up.

All other defined terms shall, unless otherwise stated, have the same meaning as the terms used in the Fixed Sum Loan Agreement.

1.2 In these Terms and Conditions, the words "you" and "your" refer to the Debtor who has signed the Fixed Sum Loan Agreement.

1.3 These terms and conditions are a a part of the Fixed Sum Loan agreement. This service is goverened by Customer Credit Act 1974

1.4 Privacy Policy is a part of the Fixed Sum Loan Agreement

1.5 By using any of our services you agree to be bound by them. Please ensure that you undertsand Terms and Conditions, you loan agreement and Privacy Policy together with all the particulars set out in it before using any of our service.

1.6 All our terms and conditions, privacy policy and agreements and any other terms set out in our website and throughout our documents are governed by English law. All communications have to be in English.

1.7 This Agreement shall be construed according to the laws of England and Wales whose courts shall be the exclusive courts of jurisdiction over any claim or matter arising under or in connection with this Agreement, Terms and Conditions and Privacy Policy.

1.8 We may change our Terms and Conditions at any time with or without any prior notice.

1.9 By using any of our services you confirm that you fully undertsood these Terms and Conditions, Our privacy Policy and any other particulars set out in this website and agree to be bound by them.

2 Financial Information

2.1 This is a Fixed Sum Loan agreement and you should ensure that you understand all the charges that you will incur by using our service. All our charges are at Our Charges page.

2.2 The service provided by PaydayOverdraft is made under The Consumer Credit Act 1974

2.3 You can settle this agreement at any time by giving notice in writing and paying off the amount you owe under the agreement.

3. Your Obligations

3.1 By using our service you confirm that you receive your salary on the dates set out in your application and that you expect to get paid on the day mentioned. The nature of your agreement is that you repay your loan straight after you have received your wages and you agree to pay your loan in full together with the charges incurred after you have received your monthly wage.

3.2  You agree to ensure that sufficient funds are available in the Account on each Payment Date in order to meet your obligation to pay the amounts you owe us on each Payment Date. You must pay us the amounts due on each Repayment Date.

3.3 You hereby authorise us to debit the amounts payable by you on each Payment Date and any other fees that you may incur under this Agreement to the debit/credit card nominated by you in your loan application with Paydayoverdraft or any of our group companies: Wage Payment and Payday loans ltd, Moneymona ltd, AI Investments ltd, Nathan Hart ltd, Andrew Hart.

Unless otherwise provided in this Agreement, all payments will be applied first to default fees payable under conditions of default, interest charges due under this Agreement and then to the Loan Amount.

3.4 If the payment is returned unpaid when we attempt to collect your due payment, we may represent the debit for the payment on Your Debit/Credit Card until we receive the total amount that you owe us. Unless we agree otherwise, if you do not pay the Total Amount Payable in accordance with this Agreement, you may incur default charges and other charges as specified in the loan particulars of this Agreement. You agree that we may also collect any such charges by way of a debit to Your Debit/Credit Card. The authority given by you to debit Your Debit/Credit Card for the purposes of this Agreement is to remain in full force and effect until your obligations to us under this Agreement are fully satisfied.

3.5 If  debit to Your Debit Card is returned unpaid or dishonoured for any reason, you authorise us to debit, without any further notice to you, any such payments by Standing Order, the form which you would have signed at the time of your loan application. The authority given by you with your Standing Order form for the purposes of this Agreement is to remain in full force and effect until your obligations to us under this Agreement are fully satisfied.

3.6 Any repayment that you make will first be applied to the interest charges, second to any default charges and other charges you incur under this Agreement and then to the Loan Amount.

3.7 When you have signed the Agreement, we will either approve or deny the advance of the Loan Amount to you. If the advance of credit is approved, the Agreement will be signed by us and concluded. Your obligations under this Agreement commence on the day that we sign this Agreement. We will send you an email or other electronic communication to notify you when this Agreement comes into force.

4. Defaults

4.1 You will be in default under this Agreement if you do not pay us the Total Amount Payable (the money you owe us) by the end of the loan Term in accordance with this Agreement. Also, if you fail to make payments in accordance with this Agreement on the scheduled Repayment Dates, you will be in default of this Agreement.

4.2 Subject to our obligations under the Consumer Credit Act 1974, all amounts owed by you under this Agreement, including interest, default charges and the Loan Amount, will become due and payable. Also we may exercise our rights to enforce this Agreement, including by commencing court proceedings in which case you may be liable for our reasonable costs as described in the Fixed Sum Loan Agreement.

4.3 You agree to cover all the expenses that we would incur if we had to pursue payment. This may include reasonable adiminstration charges, court fees, bailiff fees and any other fees that we would incur as a result of your non payment according to your loan agreement and our terms and conditions.

4.4. UPON NON COLLECTION THERE WILL BE A CHARGE OF £25.00. WITHIN 3 DAYS A DEFAULT FEE OF £25.00 AND A LETTER. EVERY DAY YOU ARE LATE THERE WILL BE A CHARGE OF £5.00 TO COVER EMAILS, TEXTS AND TELEPHONE CALLS. In addition there will be a £25.00 charge each month where we try to take the payment and send a letter.

4.5. BEYOND

Beyond are the following options available to us ALL COSTS TO BE BORNE BY THE DEFAULTER.

1/Court application and judgement £400 plus judgement fee of £75.00

2/ Attachment of earnings cost £275.00

3/ Bailliffs-who visit your home. Cost £195.00 in addition to the court fee.

4/ garnishea order-freeze your bank account-£350.00 including court fee

5/ Bankruptcy order £1500. This does not include the court fee

Repayment plans can be set up at any stage if we are agreeable to the terms provided by both sides and will cost £25.00 to set up. If broken, like all defaults there is a £25.00 default charge and £25.00 letter charge applied. We reserve the right to attempt at least once a week to take money from the debit card you have provided to all of the websites owned by Wage Payments and Payday Loans Ltd. The charge for each non collection is £5.00. This is seperate to the non collection fee of £25.00 on your first repayment date.

PLEASE NOTE: If we take you to court the charge will include the work to take you to court plus the charge to take you to judgement and to a warrant(only one). If we incur more charges this will be outstanding even if you pay off the judgement amount. ie Winnie gets a judgemnt in her name for £1104.07. This includes £650 in charges. This composes of court fee of £25-150.00. Then there are charges for each months chasing of £25.00 per month. non collection fee of £25.00 per loan repayment date as agreed at the end of term or an agreed repayment arrangement. Then a set up repayment plan is £25.00 plus if that is not collected then there is a further £25.00. Also default fees of £25.00 for a repayment plan default will also apply. There is a court fee admin of £190.00 PLUS a fee of £65.00 for the admin for applying for judgement and £175.00 for a warrant. THIS DOES NOT INCLUDE THE COURT FEE WHICH IS ADDITIONAL.

5. Cancellation

5.1 Under the Financial Services (Distance Marketing) Regulations 2004 you have a right to cancel this Agreement up to 14 days after your agreement has commenced. You may exercise this right by giving a written notice.

    5.2 If You cancel the Agreement after we have made the advance, You will still be required to repay the Amount of Credit together with the administration fee of £15.00 and any interest incurred on a pro rata basis. Interest will be charged till you repay your loan.

    5.3 Please note that your loan, together with the fees has to be repaid within the 14 days for the cancelation right under the above mentioned regulations to apply. if you fail to do so, your agreement will be in place and according to your Fixed Sum Loan agreement particulars.

    5.4 Once you have paid the full loan amount together with the interest incurred and applicable charges, your and our obligations under Loan Agreement will be terminated.

    5.5 If we have received your cancelation notice before the Loan Amount has been credited to your nominated bank account, we will not debit your bank account or Debit Card and both your and our obligations under this agreement will be terminated

    6. Miscellaneous

    6.1 Your obligations under this Agreement are unsecured.

    6.2. To improve the efficiency of our processes, this Agreement and all other communication between you and us are, unless otherwise stated, to be provided by way of electronic means. These are principally email, our website or the telephone. You agree to follow the instructions for entering into this Agreement which you will do by the means of ticking a box available in the "signature" segment in the Credit Agreement page.

    6.3 We reserve the right to change these Terms and Conditions. Such changes will be communicated to you in accordance with the requirements of any applicable law and will commence in accordance with the requirements of any such law.

    6.4 If, at any time, we waive an entitlement to enforce any of our rights under this Agreement, this waiver will not prevent us from taking action to enforce our rights in the future.

    6.5 Any notice or demand we give you will be assumed to have been properly given if served on you personally, or left or sent by prepaid envelope addressed to you at your current address or last known business or private address. If sent by first class post it will be assumed to have been received by you [5 business days] after posting.

    6.7 You grant us permission to contact your employer at any time as may be reasonably required by us.

    6.8 We may transfer all or any of our rights under this Agreement with or without any prior notice.

    6.9 You authorise us to collect any monies owed under the Agreement from any debit card account of which you have supplied details to us. We may make these attempts as frequently and at any time we choose while there is an overdue balance on your loan account, up until the time where the total amount collected equals the total amount owed. At this stage it will be deemed that your loan has been fully repaid. We do not have to give notice of these intended collection attempts.

     

    7.0 Times to call. These times are 8am to 9pm at night and can be 7 days a week. This is agreed by you when you sign this agreement. Emails are 24/7/365 days of the year and are deemed not intrusive and are acceptable to you from signing this agreement. Text messages can be sent 7 days a week from 7am till 12pm as the same as emails can be switched off. All these terms you agree to when you sign this agreement.

    7. Complaints
